TERMS AND CONDITIONS (T&C)

1. General & Scope of Application

All services and deliveries of goods provided by Ambra UV PROTECTION to the customer are carried out exclusively on the basis of the following General Terms and Conditions. Deviating regulations are only valid if they have been agreed upon in writing. By placing your order, you acknowledge these terms and conditions. We reserve the right to adapt the delivery and payment terms for future orders at any time.

2. Ordering Process, Conclusion of Contract, and Order Quantities

You can select goods from the product range of our Ambra UV PROTECTION online shop and collect them by clicking the "add to cart" button. By completing the order, you submit a binding offer to purchase the goods currently in your shopping cart. The presentation of products in the online shop does not constitute a legally binding offer.

The order confirmation automatically sent by email thereafter merely documents the receipt of your order. A purchase contract is only concluded upon an express declaration of acceptance by Ambra UV PROTECTION (shipping confirmation) or by the physical dispatch of the ordered goods to you.

Household Quantities:
We sell our goods in the online shop exclusively in standard household quantities. We reserve the right to unilaterally cancel orders that exceed these quantities or indicate commercial resale without providing reasons. For larger quantities, please contact us in advance directly by email for a B2B transaction.

Delivery Reservation & Availability:
Should an ordered product unexpectedly be unavailable or if the order is cancelled by us, we will inform you immediately. Any payments already made will be promptly and fully refunded in this case.

3. Shipping, Delivery, and Transport Risk

Shipping and Delivery:

  • For customers from the European Union (EU): Delivery is carried out by DHL or a comparable shipping service provider. Subject to availability in stock, the goods will be dispatched immediately. If an item is temporarily unavailable, we will inform you by email about the expected delivery time. Standard shipping is free of charge for you.

  • For customers from Switzerland (CH): Delivery is carried out by Swiss Post or a comparable shipping service provider. Subject to availability in stock, the goods will be dispatched immediately. If an item is temporarily unavailable, we will inform you by email about the expected delivery time. Standard shipping is free of charge for you.

Transport Risk:

  • For consumers residing in the EU: The risk of accidental destruction and accidental deterioration of the goods during transit only transfers to you upon delivery of the goods to you.

  • For customers residing in Switzerland (CH): The risk transfers to the buyer upon handover of the goods to the transport service provider.

 

4. Prices and Payment Terms

The prices stated are final prices. For customers residing in Switzerland (CH) and the European Union (EU), the prices include the applicable statutory value-added tax (VAT). Since shipping for CH customers is handled from a Swiss warehouse and for EU customers from an EU warehouse, no additional customs duties, import taxes, or handling fees apply to the final consumer.

Payment for the goods is made in advance using the payment methods offered in the online shop (in particular credit card, PayPal, Apple Pay, or Google Pay). Payment by sending cash or cheques is excluded. The goods remain the property of Ambra UV PROTECTION until full payment has been received.

 

5. Right of Withdrawal for Consumers in the EU

This section applies exclusively to customers residing in the European Union (EU). For customers residing in Switzerland, there is no statutory right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reasons. The withdrawal period is fourteen days from the day on which you or a third party named by you took possession of the goods. To exercise your right of withdrawal, you can use the withdrawal link provided on our website, use the model withdrawal form stored there, or inform us of your decision by means of a clear declaration (e.g., by email).

Consequences of Withdrawal:
If you withdraw from this contract, we shall refund all payments received from you without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal was received by us. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods.

Cost Allocation for the Return:
If you make use of your statutory right of withdrawal, you as the buyer shall bear the direct costs of returning the goods. Please ensure the package is sufficiently stamped. Should you return the package carriage forward (unfranked), we reserve the right to deduct the penalty and postage fees charged to us by the shipping service provider from your refund amount.

6. Warranty and Liability for Defects

For consumers residing in the EU:
The statutory liability law for defects of the European Union applies. The warranty period is two years from delivery of the goods. In the event of defects, you have the right to supplementary performance (remedying of defects or replacement delivery), reduction of the purchase price, or withdrawal from the contract in accordance with statutory regulations.

For customers residing in Switzerland (CH):
The warranty period and defect rights for customers residing in Switzerland are governed by the statutory provisions of the Swiss Code of Obligations (CO). The customer's right to rescission (withdrawal from the contract) or reduction (price discount) is hereby excluded, provided that Ambra UV PROTECTION delivers defect-free replacement goods or repairs the defect within a reasonable period. If the replacement delivery or repair fails, the customer is entitled to the statutory rights of reduction or rescission. Obvious defects must be reported to Ambra UV PROTECTION in writing (e.g., by email) within 5 working days after receipt of the goods.

7. Data Protection

We will not pass on personal data to unauthorized third parties without your express consent. Further information regarding the collection and processing of your data can be found in our separate Privacy Policy.

8. Discounts and Special Promotions

Discounts cannot be combined and do not apply to already discounted special offers or promotional goods.

9. Applicable Law and Jurisdiction

Substantive Swiss law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers residing in the European Union (EU), this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn (favorability principle).

For all disputes arising out of or in connection with these T&C and the contracts between Ambra UV PROTECTION and customers residing in Switzerland, the statutory place of jurisdiction according to the Swiss Civil Procedure Code shall apply. For consumers from the EU, the mandatory European jurisdiction regulations apply (lawsuit at the consumer's place of residence).

10. Copyright, Design, and Trademark Protection

All products, designs, prototypes, photos, logos, graphics, texts, reports, and programming routines presented on these pages, which are proprietary developments of Ambra UV PROTECTION or have been prepared by us, are the intellectual property of the protected brand Ambra UV PROTECTION and are protected by copyright, design patent law, or trademark law. They may not be copied, imitated, modified, or otherwise used commercially without our prior express written consent. All rights, in particular to product and textile designs as well as registered or unregistered trademarks, remain fully reserved.

11. Severability Clause

Should individual provisions of these T&C be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. In place of the invalid or unenforceable provision, the legally permissible regulation that comes closest to the economic purpose pursued by the contracting parties with the invalid or unenforceable provision shall be deemed agreed. The same applies in the event that these T&C contain a loophole.
